Terms of Service

You must be at least 18 years old (or the age of majority in your jurisdiction) and legally able to enter into a binding contract. By placing an order you represent that the information you provide is accurate and that you are authorised to use the payment method submitted.

All prices are listed in USD and exclude any duties, import taxes or customs fees, which are the sole responsibility of the recipient. Prices, promotions and product availability may change at any time without notice.

An order confirmation email is an acknowledgement of receipt only and does not constitute acceptance of your order. We reserve the right to refuse, limit, cancel or refund any order at our sole discretion — including, without limitation, orders that appear fraudulent, contain pricing errors, exceed normal household quantities, or violate these Terms.

We make every reasonable effort to display products accurately, however actual colors, textures and fit may vary slightly due to monitor settings, lighting and individual body shape. Such variations do not constitute a defect and are not grounds for a claim beyond our standard return policy.

Estimated delivery times are provided in good faith but are not guaranteed. Once a parcel is handed to the carrier, fulfilment is complete and risk of loss passes to the customer.

To the maximum extent permitted by law, Lunova is not liable for: carrier delays, lost or stolen packages once marked “delivered”, incorrect shipping addresses provided by the customer, weather events, customs holds, strikes, pandemics, force majeure, or any other event outside our reasonable control. Any claim against the carrier must be filed by the customer with the carrier.

Our return window, eligibility criteria and refund timing are set out in the Returns policy, which is incorporated into these Terms by reference.

Refund processing times depend on the original payment provider and banking networks; Lunova is not responsible for delays caused by Stripe, PayPal, banks or card issuers. Refunds will be issued to the original payment method only.

All content on this site — including the Lunova name, logo, product designs, photography, copy, code and the “SoftSculpt™” mark — is owned by or licensed to Lunova and protected by international IP laws. You may not copy, scrape, resell, reproduce or use any content without our prior written permission.

The site and all products are provided on an “as is” and “as available” basis. To the maximum extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, performance, durability and non-infringement. Activewear is a personal-use textile product; results, fit and feel are inherently subjective.

To the fullest extent permitted by applicable law, Lunova, its founders, employees, suppliers and partners shall not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill or other intangible losses, arising out of or related to your use of the site or any product, even if advised of the possibility of such damages.

Our total aggregate liability for any claim arising out of or relating to these Terms or the products shall not exceed the amount actually paid by you for the specific product giving rise to the claim, capped at USD 100.

You agree to indemnify, defend and hold harmless Lunova and its affiliates from and against any claim, loss, liability, demand or expense (including legal fees) arising out of your breach of these Terms, your misuse of the site or any product, or your violation of any law or third-party right.

These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law rules. Any dispute shall be resolved exclusively by binding individual arbitration in California; you waive any right to a jury trial or to participate in a class action. EU consumers retain non-waivable rights granted by their local law.

We may update these Terms at any time. The “Last updated” date above will reflect the latest version. Continued use of the site after changes constitutes acceptance.
